The announcement of Q’Orianka’s return to the popular Western series comes nearly two months after her real-life drama was revealed by the California Department Of Insurance.
In July, the actress was charged with two felony counts of workers’ compensation fraud after collecting nearly $97,000 in disability benefits, according to Entertainment Weekly.
In a statement to , her attorney, Michael Becker, maintained the actress plans to ‘vigorously defend herself and asks that she be afforded the presumption of innocence both in and outside the courthouse.’
Kilcher, 32, allegedly injured her neck and right shoulder while working on the film Dora And The Lost City of Gold in October 2018. She saw a doctor that year but stopped treatment and did not respond to the insurance company handling her claim, according to CDI.
A year later, Kilcher allegedly told a doctor handling the insurance claim that she had been offered work but couldn’t take it because of severe neck pain from her injury.
In all, she received $96,838 in temporary disability benefits between 2019 and 2021.

But after an investigation, it was discovered that Kilcher had actually worked on Yellowstone for several months in 2019, which was during the period of time that she claimed to be disabled by her injuries, the insurance department claims.
‘According to records, she returned to the doctor and started receiving disability benefits five days after last working on the show,’ the statement said.
Kilcher ended up surrendering to authorities and was arraigned on the fraud charges in May.
The German-born star’s attorney said she was hurt while riding as a passenger in a production vehicle.
‘Third-party doctors verified her injury and entitlement to benefits. Ms. Kilcher was at all times candid with her doctors and treatment providers, Becker said, adding, ‘And she never intentionally accepted benefits that she did not believe she was entitled to.’
